Time to work up those walkups to the Supreme Court's big transgender moment

On March 28, the U.S. Supreme Court hears arguments in the Gloucester County School Board case, its first encounter with the growing transgender rights movement.

Journalists, it's time to work up those walkups.

The basics: The Obama administration’s Departments of Education and Justice notified all U.S. public schools last May that to qualify for continued federal funding they need to follow each student’s sense of personal  “gender identity,” as opposed to birth biology, regarding access to “sex-segregated restrooms, locker rooms, shower facilities, housing and athletic teams (.pdf document here)."

That change redefined  “sex” under Title IX of the anti-discrimination law in question. For 44 years before that, the government thought “sex” meant  biological gender, not an identity that may conflict with it. In the current case, an anatomically female Virginia high schooler who is transitioning wants to use boys’ toilets instead of unisex facilities the school provides. Local school districts are caught between transgender rights appeals and community concerns about privacy and security.

The case’s significance is not ended by the February 22 decision of the incoming Donald Trump administration to rescind the Barack Obama directive for now. Access to locker rooms and showers are also part of this hot-button debate.

With gay marriage legalized throughout the United States by the Supreme Court, the LGBTQ movement is focusing all its moxie on transgender rights. The belief that gender is “assigned” at birth but flexible, rather than fixed by biology, gains cultural clout from important segments of the Democratic Party, big business, the academic world, the entertainment industry, professional and college athletics, and the like.

That poses a major challenge for advocates of religious liberty, already on the defensive with other issues.

Is this a news story? National Catholic Scouting committee has rejected trans policy shift

Welcome to another edition of what could become a regular feature in these confused times for mainstream journalism. The problem is that I don't know what we would call it.

We could call this feature "Got News?" However, we tried that already here at GetReligion and the concept never caught on. The whole idea was that there is often valid news -- often highly important news -- reported in alternative news publications (think denominational press services), yet these stories rarely seem to get covered in the mainstream press.

Then again, the "Got News?" concept doesn't really work when journalists in mainstream newsrooms spot a story, then cover that story, but then fail to offer follow-up reports that let news consumers know about important developments that same ongoing story.

As any experienced journalist knows, it is very rare for major story to break then just freeze. If there is a big news earthquake, there tend to be aftershocks. What would we call this concept -- Got Aftershocks?

This brings me to the Boy Scouts of America. Again.

The other day, I wrote a post about a New York Times report about the decision to begin allowing transgender boys to join the Boy Scouts. This was an interesting report in that -- rare for the Gray Lady -- it focused almost totally on the views of conservative critics of the change and contained next to zero material from voices on the winning side of the debate.

I called that post: "Boy Scouts push trans button: So in which pulpits and pews are people celebrating?" In other words, for reporters covering religion, there were big questions that needed to be answered as the aftershocks of this decision spread into the religious groups that host Scout troops. While some conservatives would head to the exit doors, I wondered how people would respond on the religious left and in the often muddled middle. Thus, I wrote:

If you know anything about Scouting, you know that -- in addition to the Baptists -- the key players are Catholics, Mormons, United Methodists and, to a lesser degree, Episcopalians. So if the goal is to figure out what happens next with this story, readers really needed to hear from leaders in those flocks, especially from progressives who actively supported the changes.
In other words, we need to hear from the winners who now get to put these policies into action. 

Soon after this, there was an important reaction from a major religious group -- as in the Roman Catholic committee that works with Scouting programs. This would be important news, right?

Religious questions play no role in this boring Chronicle of Higher Education look at polyamory

One of the questions that your GetReligionistas hear from readers all the time is this: "What is the mainstream press?"

That isn't the precise wording, of course, since readers are usually asking about specific publications. They want to know if The Daily Beast is "mainstream," which is a question that we've been asking for years. They want to know if MSNBC and Fox News are "mainstream." The answer is "yes," but you have to know the difference between news shows and opinion shows.

It also helps to remember that these are strange times. These days, one is just as likely to see a hard-news story from Baptist Press (or the Catholic News Agency) that quotes several qualified, on-the-record sources on both sides of a debate about a hot-button social issue as you are to see that happen in, well, the New York Times. On most religious and social issues, the Times is mainstream -- but with a doctrinal point of view. Sort of like Baptist Press?

This brings me to an interesting feature that ran in a very, very establishment, mainstream publication -- The Chronicle of Higher Education. The doubledecker headline proclaims: " ‘I Have Multiple Loves’ -- Carrie Jenkins makes the philosophical case for polyamory."

Now, this long piece is called a "review," since it sort of focuses on this scholar's book "What Love Is: And What It Could Be." Yet anyone who has lived and worked in the world of higher education knows that, in the format of the Chronicle, this is actually a first-person, reported feature story about an important news topic. What is the topic, in this case? Which word is more important, "philosophical" or "polyamory"? Here is the overture:

Carrie Ichikawa Jenkins and I have plans to meet her boyfriend for lunch. But first we have to go home to walk the dog. Her husband, Jonathan Jenkins Ichikawa, is out of town at a conference for the weekend, and earlier that morning Mezzo, their labradoodle mix, got skunked; Jenkins says Mezzo is still feeling shaky. Before I traveled to meet her in Vancouver last June, she told me on the phone that most "mono" people misunderstand the challenges of polyamory -- the practice of being openly involved romantically with more than one person at a time.
"People ask, ‘Tell me about the downsides,’ " Jenkins says. "They expect the answer to be that it’s so hard jealousy-wise. But the most common answer is timing and scheduling. I’m a fairly organized person, so I don’t find it super challenging."

Boy Scouts push trans button: So in which pulpits and pews are people celebrating?

So the Boy Scouts have made another move to dance with the Sexual Revolution, opening the doors to transgender boys.

As you would expect, there are all kinds of religion angles to this important culture-wars story. As you would expect, the New York Times led with words of praise from "critics of the organization who for years have called for more inclusive membership rules." The story also understands that, while some people celebrated the decision, others were grieving.

The twist in this particular Times report -- "Conservatives Alienated by Boy Scouts’ Shift on Transgender Policy" -- was that the story focused almost exclusively on the voices of the losers, thus missing a key element of where this story may be headed in the future.

Yes, you read that right -- the Times pretty much ignored the views -- religious and cultural -- of key leaders on the victorious Religious Left. Maybe that angle will get ink in future coverage? Here is a crucial piece of background material, which follows extensive comments from the Rev. Russell Moore of the Southern Baptist Convention:

Whether the new rules would lead to an influx of transgender scouts seemed uncertain. Besides one highly publicized case of a transgender boy being excluded from a New Jersey Scouting unit, there had been limited attention on the issue before this week. Boy Scouts officials declined to be interviewed, and would not comment on how many youths the decision might affect.
In a statement, a spokeswoman for the Boy Scouts said it was “no longer sufficient” to rely on a birth certificate to determine gender. “The B.S.A. is committed to identifying program options that will help us truly serve the whole family,” said the spokeswoman, Effie Delimarkos, adding that those efforts would remain “true to our core values, outlined in the Scout Oath and Law.”
For many years, the Boy Scouts have found themselves facing conflicting forces on issues of sexuality and inclusion. The Scouts contended with a pattern of declining membership, canceled corporate donations and public criticism over the group’s restrictions on gay youths before easing those rules in 2013. And the move this week to allow transgender youths was hailed by some as a positive, overdue step toward equality.

So the Southern Baptists -- a major player in terms of churches hosting Scouting programs -- are disappointed and this latest BSA policy shift may push more religious conservatives toward the exit door (to alternative programs such as Trail Life USA.

But who are the other major players, on the religion side of this debate?

Gay and transgender issues underscore a Godbeat rule: Carefully monitor parochial media

In late 2016 the Colson Center for Christian Worldview assembled endorsements from dozens of Christian leaders for a conservative declaration decrying problems with religious freedom with the gay and rapidly emerging transgender issues.

Coverage to date underscores a perennial rule of thumb in religion coverage: Carefully monitor parochial religious media -- and in this case also gay media -- to catch developments that might have broader significance.

Apparently the earliest story on this occurred in the Seattle Gay News (December 2), and then online postings by religious and conservative media. Eventually, mainstream press articles appeared, but in outlets like the Deseret News of Salt Lake City (January 12) and Colorado Springs Gazette (January 13).  As of this writing, The Guy found nothing in major national media (or The Advocate).

Did the sponsors try and fail to gain publicity? Or was this designed to rally activist insiders, not to sway public opinion?

Either way, there’s ample room left for reporters to take a look.

Activists and ideologues continually pepper the media with such petitions on this or that, signed by the highest-profile endorsers they can manage to muster. Amid the glut, why would this document be worth journalistic consideration? Hold that thought till we scan what the text says.

It contends that laws and administrative rulings to protect “sexual orientation” and “gender identity” (SOGI) interests “threaten basic freedoms of religion, conscience, speech, and association” and “violate privacy rights.” Such pressures “attempt to compel citizens to sacrifice their deepest convictions on marriage and what it means to be male and female,” through a range of penalties for both individuals and organizations.

On marriage, it explains, a small business may be willing to “serve everyone” yet in conscience cannot be involved with a same-sex wedding. On the transgender question, people may want “to protect privacy by ensuring persons of the opposite sex do not share showers, locker rooms, restrooms, and other intimate facilities.”

What's to be learned from the religious makeup of U.S. Congress members?

On January 3 the Pew Research Center issued its biennial “Faith on the Hill” listing of the religious identifications for each member of the incoming U.S. House and Senate, using biographical data compiled by CQ Roll Call. Reporters may want to tap scholars of both religion and political science for analysis.

Coverage in the Christian Science Monitor and other media emphasizes that although religiously unaffiliated “nones” are now as much as 23 percent of the population, members of Congress are lopsidedly religious -- on paper -- with 90.7 percent identifying as Christian, close to the 94.9 percent back in 1961.

Only popular three-term Rep. Kyrsten Sinema (D-Arizona) officially has no religious affiliation, though several members are listed as “don’t know/refused,” along with many generic identities of  "nondenominational" or “Protestant unspecified.”

What’s the news significance here? After all, formal identifications often tell us little about an office-holder’s actual faith, or stance on the issues, or whether there’s a connection. Consider liberal Sonia Sotomayor, conservative Clarence Thomas and straddler Anthony Kennedy, all self-identified Catholics on the U.S. Supreme Court, or all the pro-choice Democrats who are "personally opposed" to abortion.

Sen. Bernie Sanders is counted as “Jewish,” but was probably the most secularized major presidential candidate yet. Does a “Presbyterian” legislator belong to the “mainline” Presbyterian Church (USA) or the conservative Presbyterian Church in America? Are these currently active affiliations, or mere nominal labels that reflect childhood involvement? In reality, are a particular legislator’s religious roots important in shaping policies?

It all depends.

Final 2016 yearenders: The Atlantic on religion and politics; RNS mourns sad, sad, tragic year

Did you know that, when it comes to religion and public life, there were both winners and losers in the year 2016?

Honest. There were.

Even with the wailing and gnashing of teeth in elite newsrooms, it is pretty clear that some people in pulpits and pews ended the year in either a good mood or, to be honest, in a divided state of mind. Many felt they had dodged what they saw as the worst-case scenario.

Once again, I am referring to the key fact at the heart of coverage of white evangelical voters in the 2016 campaign -- the fact that the evangelicals who voted for Donald Trump were divided between those who supported Trump and those who felt they had to risk voting for him because of their fears of Hillary Rodham Clinton's clearly stated views on issues linked to religious liberty. There were also millions of Catholics and Mormons in that same predicament.

One more time! Let me point readers toward this Christianity Today analysis of research by the Pew Research Center. That prophetic mid-summer headline:

With half of voters dissatisfied with both presidential candidates, white evangelicals primarily plan to oppose Clinton.

Now, in one of the last 2016 Yearenders that I saw, Atlantic Monthly captured a bit of this some won, some bitterly lost and many just felt relieved atmosphere in post-election America. It also -- even from it's left-of-center editorial view -- noted the role that religious-liberty debates played in all of this. So consider these two chunks of that roundup:

The Washington Post team is surprised, it seems, that 'free agency' matters to Mormons

They say politics makes strange, er, bedfellows.

Well, here’s proof: The Radio City Music Hall Rockettes and the Mormon Tabernacle Choir will each -- and very much separately -- perform in Washington on Inauguration Day, January 20. And just as some Rockettes opted out of performing for President-elect Donald Trump’s celebrations, so, too, did one member of the “MoTab,” as the choir is informally known, decline.

Except the choir member, soprano Jan Chamberlin, did more than drop out of the Washington gig. She resigned from the choir itself, after five years in a much-sought-after position among members of the Church of Jesus Christ of Latter-day Saints  who have exceptional musical abilities.

Chamberlin compared performing for the real estate mogul-turned-politician with someone “throwing roses [before] Hitler.” The choir’s acceptance of the invite filled her with conflicting emotions. Let’s drop in on how the Washington Post picked up the story:

Ever since “the announcement” -- as Chamberlin called it -- she has “spent several sleepless nights and days in turmoil and agony,” she wrote in a Facebook post that was no longer public by Friday evening. “I have reflected carefully on both sides of the issue, prayed a lot, talked with family and friends, and searched my soul. I’ve tried to tell myself that by not going to the inauguration, that I would be able to stay in Choir for all the other good reasons.”
Ultimately, though, Chamberlin decided that she could not stay in the Mormon Tabernacle Choir. The Salt Lake City Tribune [sic] reported that Chamberlin, a singer in the famed group, is resigning after learning that the choir would appear at President-elect Donald Trump’s inauguration in January.
“I simply cannot continue with the recent turn of events,” she wrote on Facebook. “I could never look myself in the mirror again with self respect.”
Chamberlin wrote that by “singing for this man” the choir would appear to be “endorsing” tyranny and fascism, and its image would be “severely damaged.” Moreover, she wrote, it would leave many feeling betrayed, as she already did.

But everybody knows that each and every member of the LDS Church is a rock-ribbed, right-leaning Republican. Right?

New York Times editor: We just don't get (a) religion, (b) the alt-right or (c) whatever

You know what, your GetReligionistas did hear something about an interesting quote from New York Times executive editor Dean Baquet during yesterday's Fresh Air program on National Public Radio. We have also seen the blitz of Twitter reactions to his words.

It was something about elite journalists struggling to "get religion," right?

The headline for this interview was highly relevant, in light of the ongoing mainstream media meltdown in the wake of the White House win by Donald Trump. That would be: " 'New York Times' Executive Editor On The New Terrain Of Covering Trump." (That link includes the transcript and a link to the audio file.)

The interview includes all kinds of interesting material, including Baquet's take on the "fake news" phenomenon and life with a president-elect who is overly fond of Twitter. 

The Times editor also explains why he believes that it's a recent phenomenon for journalists to feel obligated to cover both sides of heated public debates, especially when journalists believe they already know the key facts. Thus, they should just print what they believe is true and that's that. Is Baquet advocating a return to the candid advocacy (often called the European Model of the Press) that dominated American journalism until late in the 19th Century?

But we are, of course, primarily interested in the quote that launched waves of emails and tweets in this direction. That would be the section in which Baquet addresses a particular news beat that has given his newspaper problems:

I think that the New York-based and Washington-based too probably, media powerhouses don't quite get religion. We have a fabulous religion writer, but she's all alone. We don't get religion. We don't get the role of religion in people's lives.

You can see how some folks would think that we'd be interested in that. However, I think it's crucial to see the wider context of where that quote appeared in this interview.

Baquet and host Terry Gross are talking about Trump and his link to truly dangerous elements in American life, over on the fringes with racists and nationalists. That, for Baquet, links directly to anger in the American heartland and that links directly to, yes, religion.
