Stay tuned: Ceasefire in battles between LGBTQ rights and religious liberty?

No doubt about it, someone will have to negotiate a ceasefire someday between the Sexual Revolution and traditional religious believers, said Justice Anthony Kennedy, just before he left the U.S. Supreme Court.

America now recognizes that "gay persons and gay couples cannot be treated as social outcasts or as inferior in dignity and worth," he wrote, in the 2018 Masterpiece Cakeshop decision. "The laws and the Constitution can, and in some instances must, protect them in the exercise of their civil rights. At the same time, the religious and philosophical objections to gay marriage are protected views and in some instances protected forms of expression."

Kennedy then punted, adding: "The outcome of cases like this in other circumstances must await further elaboration in the courts."

The high court addressed one set of those circumstance this week in its 6-3 ruling (.pdf here) that employers who fire LGBTQ workers violate Title VII of the Civil Rights Act, which banned discrimination based on race, color, religion, sex or national origin.

Once again, the court said religious liberty questions will have to wait. Thus, the First Amendment's declaration that government "shall make no law … prohibiting the free exercise of religion" remains one of the most volatile flashpoints in American life, law and politics.

Writing for the majority, Justice Neil Gorsuch -- President Donald Trump's first high-court nominee -- expressed concern for "preserving the promise of the free exercise of religion enshrined in our Constitution." He noted that the Religious Freedom Restoration Act of 1993 "operates as a kind of super statute, displacing the normal operation of other federal laws." Also, a 1972 amendment to Title VII added a strong religious employer exemption that allows faith groups to build institutions that defend their doctrines and traditions.

Nevertheless, wrote Gorsuch, how these various legal "doctrines protecting religious liberty interact with Title VII are questions for future cases too."

In a minority opinion, Justice Samuel Alito predicted fights may continue over the right of religious schools to hire staff that affirm the doctrines that define these institutions -- even after the court's 9-0 ruling backing "ministerial exemptions" in the Hosanna-Tabor Evangelical Lutheran Church and School case in 2012.

New podcast: What's next in terms of Sexual Revolution vs. religious liberty news?

Decisions by the U.S. Supreme Court usually make headlines, especially when the court is bitterly divided. Few things cause as much chaos in American life than 5-4 decisions from on high.

Meanwhile, 9-0 decisions — which are actually quite common — often receive little attention. They are, however, extremely important because they display a unity on the high court that should, repeat “should,” be hard to shatter.

I bring this up, of course, because of the 6-3 SCOTUS ruling redefining the word “sex” in Title VII of the Civil Rights Act of 1964. In the wake of that historic victory for LGBTQ activists, reporters who cover legal issues, especially church-state conflicts, have to start thinking: Where is this story going now?

That’s precisely what “Crossroads” host Todd Wilken and I talked about in this week’s podcast (click here to tune that in). Journalists can expect clashes sooner, rather than later, when it comes to LGBTQ Americans presenting evidence that they were fired, or were not given a fair chance to be hired, at businesses operated by traditional Christians, Jews, Muslims, etc.

One could start a timer, methinks, to measure how long it will be until the first story of this kind breaks involving Hobby Lobby or Chick-fil-A. The more important story, however, will be how this new legislation passed by the Supreme Court will affect traditional religious believers across the nation who own and operate small businesses. Journalists looking for stories on the cultural left will want to visit businesses led by religious believers who stress that they have had no problems with their employees.

However, let’s go back to that other religious question: What is the next shoe that will drop?

With that in mind, reporters may want to ponder the implications of a 9-0 church-state decision at the Supreme Court in 2012 — which isn’t that long ago, in legal terms. I am referring to Hosanna-Tabor Evangelical Lutheran Church and School v. EEOC. That’s the case that strengthened the concept of a “ministerial exception” that gives doctrinally defined religious institutions great freedom in the hiring and firing of employees. The bottom line: The state isn’t supposed to become entangled in personnel decisions that involve doctrine.

Why does that matter right now? As I argued this week (“ 'But Gorsuch...' crashes at Supreme Court: Now watch for 'Utah' references in news reports“), debates about Title VII religious exemptions are looming in the near future. At that point, all roads lead to the 9-0 ruling on Hosanna-Tabor.

The question legal minds are asking: Are we about to see a drama with two acts?

'But Gorsuch...' crashes at Supreme Court: Now watch for 'Utah' references in news reports

It’s no surprise that mainstream news reports about the U.S. Supreme Court’s 6-3 ruling on LGBTQ rights for secular workers included a strong note of celebration. To the victors go the spoils and this was a big win for the cultural left and, one can only assume, the new middle America — as defined by the Harvard and Yale law schools.

The unanswered question hanging over all of this was, of course, the same one that haunted the majority opinion written by Donald Trump’s first choice for the high court. That would be: What happens to the bigots — sexual orientation now equals race — in churches, synagogues, mosques, etc., who run schools and nonprofit organizations built on centuries of premodern doctrine? After all, it’s hard to tolerate religious believers who are intolerant.

It’s also important, of course, to ask whether grieving believers on the religious and cultural right will stay home during the 2020 elections since they can no longer say, “But the Supreme Court” when justifying votes for the Tweeter In Chief.

Expect waves of coverage of that in the days ahead, of course.

Political wars vs. religion news? No contest.

What matters the most, to readers in middle America, is how this story was covered by the Associated Press. In this case, AP stuck close to the political and legal angles of the decision, with little or no interpretation from activists on the left, the right or in the middle.

In other words, this was not a story in which First Amendment content was crucial. So there. The headline: “Supreme Court says gay, transgender workers protected by law.” Here’s the overture:

WASHINGTON (AP) — The Supreme Court ruled Monday that a landmark civil rights law protects gay, lesbian and transgender people from discrimination in employment, a resounding victory for LGBT rights from a conservative court.

The court decided by a 6-3 vote that a key provision of the Civil Rights Act of 1964 known as Title VII that bars job discrimination because of sex, among other reasons, encompasses bias against people because of their sexual orientation or gender identity.

Journalism cancels its moral voice: What does this mean for Catholic news? For religion news?

I have always been fascinated with the concept that journalism functions as a moral watchdog on our society. As someone who spent most of his career at two New York tabloids (15 years at the New York Post, two others at the rival Daily News), reportage and story selection revolved heavily around morality.

A lot of it mirrored traditional religious morality.

Editors and reporters never used that language to describe their work, of course.

They still reported both sides of the story and gave people who were the subject of said story the chance to rebuke accusations. Whether it was a news account about an unfaithful politician (former New York Gov. Eliot Spitzer and former Congressman Anthony Weiner spring to mind), a Wall Street executive who embezzled money or a regular guy who shot and killed a convenient store clerk over a few dollars, if you broke one of the Ten Commandments then you had a very good chance of being splashed all over page one.

ProPublica, one of my favorite investigative news sites, has a mission statement that sums up this philosophy very well:

To expose abuses of power and betrayals of the public trust by government, business, and other institutions, using the moral force of investigative journalism to spur reform through the sustained spotlighting of wrongdoing.

Where does this morality come from? It is rooted primarily in Judeo-Christian values, something that helped form American society during what is now called The Great Awakening.

News coverage — be it about politics, culture or religion — is largely made up of crimes (in the legal sense) or lapses in judgement (in a moral one). But the news media has changed in the Internet age, primarily because of social media. Facebook, Twitter and TikTok, to name just three, allows users — everyday people — to pump out content. That content can take many forms — from benign observations to what’s called hot takes — for all to read and see.

Truth, fact checking and context are not important. What matters are likes and followers. What we have now is something some have called “The Great Awokening” and it appears to have forever transformed our political discourse and the journalism that tries to report on it.

Mainstream news organizations, in their quest for clicks amid hope of figuring out a new business model, now mirror the content we all see on social media platforms.

Concerning the familiar journalistic need to seek out history (and a Catholic angle to July 4th)

A trip to Washington, D.C., especially around the time of Independence Day, is always a good way to get the history juices flowing. It’s also a good way to get story ideas if you’re an editor or reporter looking for a new angle to this annual holiday.

Walking around the nation’s capitol is also a reminder of how much religious faith and this nation’s founding are connected, in terms of personalities and big themes. God is everywhere in this country’s past and the monuments that populate this wonderful city are a reminder of it.

One statue that many often ignore or neglect to focus on is that of Charles Carroll located in the National Statuary Hall collection. Not only is his life an excuse to cover July 4th through a new lens, but also gives readers the chance to learn about our country’s religious origins.

Who was Carroll? It’s a question not too many people have asked, in recent decades. It is one that editors and reporters should be flocking to cover. If anything, it would allow for news coverage to get away from the standard tropes that include fireworks, grilling recipes and mattress sales. Carroll was the only Roman Catholic to sign the Declaration of Independence and its longest-living signer. That alone would be reason enough to focus some of the coverage on this man, especially in Maryland media — in the state where he lived and died.

Crux did a wonderful feature in 2016 on Carroll, complete with tons of history and interviews with experts who studied Carroll’s life. This is how the piece opens:

On July 4, 1826 — the 50th anniversary of the Declaration of Independence — one of the most amazing coincidences in U.S. history unfolded. On that day, Thomas Jefferson, the Declaration’s author, and John Adams, perhaps its greatest advocate, died within hours of each other.

David McCullough’s masterful biography John Adams tells the poignant story of how the two patriots he called “the pen” and “the voice” of the Declaration, who had helped forge liberty in their new nation later became bitter political rivals but in their old age corresponded as friends.

But their rivalry even extended to their dying moments, as McCullough noted that Adams on his deathbed in Massachusetts whispered, “Thomas Jefferson survives.” Yet earlier that afternoon, Jefferson had died in Virginia.

And then there was one.

USA Today: Can a state allow an adoption agency to discriminate on the basis of religion?

I’m always amazed how, once news organizations discover an ultra-conservative religious group, they treat it as so much fresh meat to be chomped on again and again.

Such is Miracle Hill, a Christian foster care and adoption agency in South Carolina that is getting endless coverage about how biased and crazy it is to only allow Protestants to adopt kids through this organization.

I wrote about them last fall when other media were going after Miracle Hill and how the local paper, The Greenville News, explained there are 10 other adoption agencies in the state that take all comers.

Yet, in USA Today, we’re hearing about Miracle Hill again, this time the target of the ire of a Catholic mom.

Aimee Maddonna, 34, a South Carolina mother of three, was turned away by a state-funded foster care agency because she is Catholic.

Maddonna went to Miracle Hill Ministries in Greenville, the state’s largest foster care outlet, asking to volunteer in hopes of one day becoming a foster parent. But the initial screening was cut short after she was asked the name of her church.

“I said, ‘Our Lady of the Rosary,’ and her exact words were, ‘You sound like you’d be the perfect mentor, but we only accept Protestant Christians.”

“Saying that the majority of the population is not suitable only because of their religion ... that’s archaic,” Maddonna said.

There are serious church-state issues here, since state funds are involved. It’s one thing to operate as a nonprofit and something else to be a nonprofit that gets tax dollars. The question is whether there are other state-assisted nonprofits with policies that affect who can, and who cannot, use their services. Are religious doctrines uniquely bad?

Reading further down, we get to the trends the article is most concerned about. This passage is long, but stay with me.

There are at least nine other states that have passed laws allowing child placement agencies to turn away anyone who doesn’t match their religious beliefs or moral convictions, including same-sex couples.

The long good-bye: The Atlantic describes the inevitable loss of Christian life in Iraq

I remember the Nineveh Plain well. I was being driven from the Kurdish city of Dohuk in far northern Iraq to the regional capital of Erbil further south and around me in all directions stretched a flat plain. To the west were low-slung hills and in my mind I could hear the footsteps of conquering Babylonian armies as they sought to overrun the city of Nineveh in 612 BC.

Irrigated by the Tigris River, it’s actually a fertile place with crops everywhere — assuming that they’re allowed to grow.

Several millennia later, it was the ISIS armies whose footsteps were heard on this plain back in 2014 when the events at the heart of this story take place.

I must say I envy The Atlantic’s Emma Green for getting sent to Iraq to do this fascinating piece along with a photographer or two. (My 2004 trip there was entirely self-funded).

The call came in 2014, shortly after Easter. Four years earlier, Catrin Almako’s family had applied for special visas to the United States. Catrin’s husband, Evan, had cut hair for the U.S. military during the early years of its occupation of Iraq. Now a staffer from the International Organization for Migration was on the phone. “Are you ready?” he asked. The family had been assigned a departure date just a few weeks away.

“I was so confused,” Catrin told me recently. During the years they had waited for their visas, Catrin and Evan had debated whether they actually wanted to leave Iraq. Both of them had grown up in Karamles, a small town in the historic heart of Iraqi Christianity, the Nineveh Plain.

But the 2003 invasion of Iraq had changed everything, including the impression that Christians had had it easy under Saddam Hussein. Once he was gone, it was payback time.

For Russia's Jehovah's Witnesses and China's Uighur Muslims, politics trump religious freedom

Political power has as much to do with religious group fortunes as do the appeal of their message and the commitment of their followers. It's no wonder that the histories of each of the three major monotheistic religions emphasize, and even celebrate, stories of persecution at the hands of repressive political leaders.

Frankly, not much has changed over the centuries, despite any assumptions that modernity has birthed generally more enlightened attitudes toward politically weak minority faiths. Lip service means little when believers face immediate threats.

Here are two examples of politically linked religious persecution that produced international headlines last week.

The first is the dire situation of Jehovah's Witnesses in Russia. They’re persecuted by the government, in part because they’ve been deemed insufficiently loyal to the state, because they’re a relatively new sect with no historical ties to the Slavs and because they're a small and politically powerless faith with few international friends.

The second example is, arguably, the even worse situation of China’s Uighur Muslims. Not only does Beijing fear their potential political power, but until now they’ve also been largely abandoned by their powerful global coreligionists, again because of blatantly self-serving political considerations.

The good news here, if that’s not an overstatement, is they've received a modicum of  international lip service of late, even if only — no surprise here — out of political self-interest.

But let’s start with the Jehovah's Witnesses. I’ve previous chronicled their situation here, focusing on how the elite international media has -- or has not -- covered them. Click here and then click here to retrieve two of my past GetReligion pieces.

The latest news out of Russia is pretty bad. Despite Russian President Vladimir Putin’s recent declaration of quasi-support for his nation’s Witnesses, a foreign-born member of the group has been sentenced to six years in prison for — well, basically for being a member of the faith.

Here’s the top of a Religion News Service report:

MOSCOW (RNS) —  A Russian court has sentenced a Danish member of the Jehovah’s Witnesses to six years on extremism charges in a case that has rekindled memories of the Soviet-era persecution of Christians and triggered widespread international criticism.

Malaysia bars Israeli para-athletes, loses major swim competition and major media ignored it

We hear a great deal these days, and appropriately so, about rising anti-Semitism across Europe, much of it masquerading as anti-Israel political rhetoric. For years we’ve known about the virulent anti-Semitic attitudes that permeate the Arab world and neighboring Turkey and Iran.

Nor is there any lack of probing news coverage about the spike in anti-Semitism here in the United States. Look no further than the recent Women's March on Washington for evidence.

Still, I urge you to read this recent analysis by Holocaust and anti-Semitism scholar par excellence Deborah Lipstadt to better understand this ominous state of affairs.

Lipstadt notes how even Israel’s government and some Jews unwittingly make the situation worse.

What we hear very little about, however, is the Jew hatred — and its geopolitical twin, the hatred of all things Israeli — that emanates from Malaysia.

This past Sunday — which coincided with international Holocaust Remembrance Day — the International Paralympic Committee cancelled a top-level swimming competition set for Malaysia later this year because of that nation’s refusal to allow Israeli athletes to compete in, or even enter, the Southeast Asian country.

Did you see anything about this in the mainstream media?

Speaking at the Oxford Union [in England] a week ago, prime minister Dr Mahatir Mohamed confirmed that the visa-denial was punitive but restated his country’s right to bar visitors from countries whose policies he disagreed with, adding that if the International Paralympic Committee (IPC) wanted to withdraw Malaysia’s right to host the tournament, “they can do so”. He has also previously described Jews as “hook-nosed” and suggested four million, rather than six million Jews, were killed in the Shoah [Holocaust].

As you might imagine, the Malaysia story has been followed closely by Israeli and Jewish diaspora media, along with Asian and Muslim-world news outlets.
