Top 10 religion-news stories of 2020: Coronavirus pandemic touched almost everything

Some years, picking the No. 1 religion story is a real challenge.

This year? Not so much.

Give the global pandemic credit for making at least one thing easy during 2020.

Let’s count down the Top 10 stories, as determined by Religion News Association members (including yours truly). I’ll sprinkle a few links to related stories into the RNA summaries:

10. “Liberty University president Jerry Falwell Jr. resigns amid controversies including a risqué photo and an alleged sex scandal. Claims of sexual misconduct also made against late evangelical apologist Ravi Zacharias and Hillsong pastor Carl Lentz.”

9. “Pandemic-related limits on worship gatherings spur protests and defiance by Hasidic Jewish groups and evangelicals led by pastor John MacArthur and musician Sean Feucht. Supreme Court backs Catholic and Jewish groups' challenge to New York's limits.”

8. “A Vatican investigation into defrocked ex-cardinal Theodore McCarrick found that bishops, cardinals and popes failed to heed reports of his sexual misconduct. Debate ensues over the legacy of sainted Pope John Paul II, who promoted him to cardinal.”

7. “Dozens of nations decry what they term widespread human-rights abuses by China against predominately Muslim Uighurs and others in Xinjiang region, many in detention camps. New U.S. law authorizes sanctions against Chinese officials deemed complicit.”

SCOTUS flips script on COVID-19 worship bans, but Francis Collins of NIH urges closures

First New York.

Now California.

With the addition of a fifth, solidly conservative member — new Justice Amy Coney Barrett — the U.S. Supreme Court has flipped the script on months of legal battles over pandemic-era worship gatherings.

“It is time — past time — to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues, and mosques,” Justice Neil Gorsuch wrote last week as the 5-4 court blocked New York from imposing strict attendance limits on religious services.

Then on Thursday, the court “sided with a California church protesting Gov. Gavin Newsom’s pandemic-related restrictions on indoor worship services,” noted the Washington Post’s Robert Barnes. The brief, unsigned order returned the issue to lower court judges and “suggests the state’s ban on indoor services is likely to fall,” reported the Los Angeles Times’ David G. Savage.

In San Francisco, Catholic Archbishop Salvatore Cordileone has complained that the city’s “treatment of churches is discriminatory and violates the right to worship,” as explained by the Catholic News Agency. In related news, the Deseret News’ Kelsey Dallas highlighted a clash over in-person classes in religious schools in Kentucky. And Boston.com’s Nik DeCosta-Klipa covered Massachusetts Gov. Charlie Baker’s concerns over “COVID-19 clusters stemming from religious gatherings.”

Here in my home state of Oklahoma, Gov. Kevin Stitt has refused to issue a statewide mask mandate that might help slow the spread of COVID-19. But he declared Thursday a day of prayer and fasting over the coronavirus, as reported by The Associated Press’ Ken Miller.

Amid a surge in COVID-19 hospitalizations and deaths nationally, a top public health official Thursday “called on religious leaders to keep their worship spaces closed, despite rising protests from some church leaders,” according to NPR’s Tom Gjelten:

Podcast: NYTimes op-ed offers sharp media criticism on SCOTUS and religious liberty

In light of trends in the past year or so, the op-ed page of The New York Times was the last place I expected to find sharp media criticism focusing on the U.S. Supreme Court, the First Amendment and, to be specific, religious liberty concerns during the coronavirus pandemic. Miracles happen, I guess.

Here’s the context. There was, of course, a tsunami of press coverage of the 5-4 SCOTUS decision overturning New York Gov. Andrew Cuomo’s aggressive rules controlling in-person religious services in New York. Frankly, the coverage was all over the place (and let’s not get started discussing the Twitter madness) and I had no idea how to write about it.

Thus, I was both stunned and pleased to read the recent Times op-ed that ran with this headline: “The Supreme Court Was Right to Block Cuomo’s Religious Restrictions.” That essay provided the hook for this week’s “Crossroads” podcast (click here to tune that in).

This op-ed was written by a former federal judge named Michael W. McConnell, who directs the Constitutional Law Center at Stanford Law School and Max Raskin, an adjunct law professor at New York University. While their essay includes lots of interesting information about the logic of the recent ruling, GetReligion readers will be interested in its commentary on how the decision was viewed in public discourse — including media coverage.

Here is a crucial block of material at the top that includes some specific facts that would have been appropriate in news stories:

Unfortunately, the substance of the decision has been drowned out by a single-minded focus on judicial politics — the first evidence that President Trump’s appointments to the court are making a difference. Maybe that is so. In the first two pandemic-related worship-closure cases to get to the court this year, it declined to intervene by 5-to-4 votes, with Chief Justice John Roberts joining the Democrat-appointed justices in deferring to state regulators. Last week’s decision went in favor of the Catholic and Orthodox Jewish plaintiffs, with the chief justice in dissent.

But politics is a distorted lens for understanding the case. Looking to the substance, six justices agreed that the Free Exercise Clause was probably violated by the governor’s order. The restrictions, which are far more draconian than those approved by the court in the earlier cases, are both extraordinarily tight and essentially unexplained. In red zones, where infection rates are the highest, worship is limited to 10 persons, no matter how large the facility — whether St. Patrick’s Cathedral (seating capacity: 2,500) or a tiny shul in Brooklyn. Because Orthodox Jewish services require a quorum (“minyan”) of 10 adult men, this is an effective prohibition on the ability of Orthodox women to attend services.

In other words, many journalists and public intellectuals — I am shocked, shocked by this — decided that Trump-era political divisions were more important than information about the legal and religious realities at pew level.

Religious liberty and foster care: five key numbers as SCOTUS weighs dogma and LGBTQ rights

We voted.

Then we waited. And fretted over the outcome. And waited some more.

While we did, perhaps some of us missed Wednesday’s arguments in the latest U.S. Supreme Court case pitting religious freedom vs. gay rights and the Sexual Revolution.

The dispute involves the city of Philadelphia ending its foster care contract with Catholic Social Services over the faith-based agency’s refusal to place children with same-sex parents.

Here are five key numbers that stood out to me:

5,000 CHILDREN IN CUSTODY

NPR’s Nina Totenberg’s reported:

On one side is the city of Philadelphia, which has custody of about 5,000 abused and neglected children, and contracts with 30 private agencies to provide foster care in group homes and for the certification, placement, and care of children in individual private foster care homes.

Reuters’ Lawrence Hurley and Andrew Chung asked a city official about the potential impact if the Supreme Court rules in favor of Catholic Society Services:

A ruling against Philadelphia could make it easier for people to cite religious beliefs when seeking exemptions from widely applicable laws such as anti-discrimination statutes.

“If individual organizations can begin to choose to discriminate against whom they want to serve, then it does begin to set an unfortunate precedent,” said Cynthia Figueroa, Philadelphia’s deputy mayor for children and families.

ZERO SAME-SEX PARENTS DENIED

Robert Barnes of The Washington Post quoted Lori Windham:

“Zero” was the answer from Windham, a lawyer for the Becket Fund for Religious Liberty, when asked how many same-sex couples had been denied the opportunity to be foster parents because of CSS policy. She said if ever approached, the agency would refer the couple to one of the more than two dozen agencies that have no issue with same-sex marriage.

THE RELIGION GUY’S ANSWER:

By a thin margin, Amy Coney Barrett won confirmation to the U.S. Supreme Court without the quizzing about her devout Catholicism — like Senate Democrats Diane Feinstein raised with Barrett’s lower-court nomination and Kamala Harris with another judicial nominee.

Nevertheless, the media pushed this theme, including her involvement with People of Praise, a close-knit community of “charismatic” Catholic families.

This was perhaps the most intense discussion of a nominee’s religion since Louis Brandeis (a justice 1916-39) became the Court’s first Jew following the agony of history’s longest confirmation process, with 19 hearings. Ostensibly, critics questioned his entanglements as a Boston lawyer, but Democratic stockbroker William F. Fitzgerald gave the game away by regretting the nomination of a “slimy fellow” with a “Jewish instinct.”

A smaller dustup involved Democratic nominee Hugo Black (on the Court 1937-71). He was denied the usual automatic deference granted a fellow U.S. Senator when reports emerged that as a young lawyer he joined the Ku Klux Klan, with its hatred of African-Americans, Catholics and Jews. Journalists only proved his KKK membership after a strong Senate vote for confirmation.

The Brandeis breakthrough launched an unwritten tradition of the Court’s “Jewish seat,” also filled by the religiously agnostic Benjamin Cardozo, who overlapped with Brandeis (1932-38), Felix Frankfurter (1939-62), Arthur Goldberg (1962-65) and the unfortunate Abe Fortas (1965-69). After a long gap, Ruth Bader Ginsburg began her celebrated tenure (1993-2020). There was also a “Catholic seat” line with Pierce Butler (1923-39), Frank Murphy 1940-49), William Brennan (1956-90) and Antonin Scalia (1986-2016).

The first Catholic on the Court was Chief Justice Roger Taney (1836-1864), who is not loudly hailed because he wrote the Dred Scott decision that’s widely blamed for precipitating the Civil War.

Podcast: How do New York Times editors handle 'real' news when it's linked to religion?

Under normal circumstances, GetReligion’s weekly “Crossroads” podcast focuses on a discussion of a major religion-beat story or perhaps a trend related to it. Every now and then, we talk about the topic addressed in my weekly syndicated column for the Universal syndicate.

This week’s discussion (click here to tune that in) is different, because the online professionals at The New York Times recently dedicated one of their “Insider” features (Times Insider explains who we are and what we do, and delivers behind-the-scenes insights into how our journalism comes together”) to a Q&A with the newspaper’s two religion reporters.

As you would expect, the hook for this piece is political — as clearly stated in the introduction. Spot any significant buzzwords in the first sentence?

The discourse surrounding the background of the Supreme Court Justice Amy Coney Barrett and the support of white evangelicals for President Trump has deepened political divisions in the country, and the conversations are two examples of why it’s important to understand conservative Christians and their impact.

The double-decker headline for the “Insider” chat says pretty much the same thing: “When Faith and Politics Meet — Two Times journalists talk about the challenges of covering religion during a pandemic in a campaign season.”

All of this reflects one of the major themes of GetReligion’s work over the past 17 years. If you want to write a religion-beat story that will automatically make it to A1, then you need to have a news hook centering on (a) politics, (b) scandal, (c) sexuality or (d) all of the above.

For way too many editors, politics is the most important thing in the “real” world — the way things that really matter get done in real life. Religious faith, on the other hand, is not really “real,” unless it overlaps with a subject that editors consider to be “real,” and politics is at the top of that list.

I would say that 90% of “they just don’t GET religion” problems that your GetReligionistas discuss here, week after week, have little or nothing to do with the work of religion-beat specialists. We cheer for religion-beat pros way more than we criticize them.

No, most of these journalism trainwrecks occur when editors assign stories that are linked to religion (or “haunted” by religious facts and ideas that journalists fail to see) to reporters who are assigned to desks dedicated to “real” topics — like politics or national news.

Before we get to the “Insider” talk with reporters Elizabeth Dias and Ruth Graham — both of whom are graduates of Wheaton College — let’s look at a recent Times story about a “real” topic, the potential political sins of a Supreme Court nominee. Looking at this piece will illustrate the topic that really needed to be discussed. That would be this — how do Times editors decide when a story deserves input from the religion-beat pros, or not?

Today's Associated Press: Why cover both sides of an important Amy Coney Barrett story?

Dear editors at the Associated Press:

Let’s discuss a few issues behind your recent feature that was sent to newspapers everywhere with this headline: “Barrett was trustee at private school with anti-gay policies.”

The key, of course, is “policies” — a vague term that way too many mainstream journalists consistently use in place of the simple word “doctrines.”

Yes, of course, traditional Catholic schools have “policies” that affect students, faculty and staff. However, these policies are almost always attempts to teach and defend the doctrines of the church. It’s significant that the word “doctrine” does not appear anywhere in this long AP piece and the same goes for the word “catechism.” Also, “scripture” is used once — by a progressive Catholic stressing that conservative Catholics are “literalists” when reading the Bible.

Anyone who has covered Catholic education for a decade or two knows what is going on here. Yes, Democrats are furious about Amy Coney Barrett’s arrival on the high court. But this Associated Press story is built on divisions inside the American Catholic church, both on moral theology linked to LGBTQ issues and fights over the goals of Catholic education in colleges, universities, seminaries and private schools such as the ones linked to Barrett and People of Praise.

With that in mind, let’s add two other factors to this case that are ignored (or all but ignored) by AP.

First of all, once upon a time there was a man named St. Pope John Paul II. In 1990, this pope issued a document entitled “Ex Corde Ecclesiae (From the Heart of the Church)” focusing on issues in Catholic education. You could tell that it was a controversial document (a) because it said Catholic doctrines should be taught and defended in Catholic schools, (b) progressive Catholics, speaking through the press, went ballistic and (c) it took almost a decade of fighting for American Catholic church leaders to act (sort of) on the pope’s guidelines.

This fight was primarily about colleges and universities, but the principals in Ex Corde are relevant to fights, these days, about classroom and student-life issues in Catholic schools at all levels. So what was John Paul II saying?

'Catholic voters' will split their votes in this election, but how will that affect swing states?

The U.S. election season has come down to its final days. Both national polling and those in battleground states see former Vice President Joe Biden with a lead. President Donald Trump has been traveling across the Rust Belt in hopes of winning key states like Pennsylvania and Wisconsin, as voters are told — once again — that the upcoming election is “the most important of our lifetimes.”

The Nov. 3 election is important, and signs continue to point to a Biden victory. Democrats, fearing a repeat of 2016 when Trump surged to a shocking victory, are countering this narrative by paying attention to many states — especially in the Midwest — that Hillary Clinton downplayed in 2016. For journalists, this leads straight to fights to attract Catholic voters of various kinds (see this previous tmatt post on that topic).

News consumers can sense some panic on the left that this election could go horribly wrong for them once again. Republicans, on the other hand, appear confident, yet cautious at the same time regarding the potential outcome.

Trying to gauge voter enthusiasm is difficult. While Trump voters do seem generally more energized — especially among evangelicals and church-going Catholics — compared to Biden supporters, the events of the past few weeks in Washington may have shifted priorities.

A majority of Catholics say they support Biden (52%), while only 40% back Trump. Nevertheless, that gap, according to the latest EWTN News/RealClear Opinion Research poll released this past Monday, shows that the race narrows significantly in swing states such as Arizona, Florida, Michigan, North Carolina, Pennsylvania and Wisconsin. In those states, Biden leads by an average of just four percentage points (48% to 44%), which is within the survey’s margin of error. Also, note this passage in that EWTN report:

Catholic voters are divided on some issues but said they are more likely to support candidates who seek to protect religious freedom (78% to 14%) and are less likely to support candidates who support taxpayer funding of abortion (52% to 34%) or who support abortion at any time during a pregnancy (60% to 28%).

Back in July, I argued that this coming election was primarily about the Supreme Court.

Press struggles to cover a complex woman: The sainting of Amy Coney Barrett, wife and mom

Well, they’re over. The Senate hearings for Supreme Court nominee Amy Coney Barrett were subdued, non-confrontative and — amazingly — ended with a hug between Sen. Dianne Feinstein, the leading Democrat on the judiciary committee and Sen. Lindsay O. Graham, her Republication counterpart.

Can’t get much better than that. We will see if Democrats have another post-hearings ambush planned, as was the case with Brett Kavanaugh.

As for coverage of the nominee herself, it was somewhere between treating her as an exotic zoo creature and understanding her as the complex person that she is. Dan Henninger of the Wall Street Journal ran an opinion piece last week that expresses my thoughts about some of this news coverage.

This week, the New York Times published an article by three cultural anthropologists (identified as reporters) who were sent to the Midwest and South to discover the origins of Judge Barrett’s religious belief.

Days earlier, another excavation team from the Washington Post produced a similar piece, called “Amy Coney Barrett served as a ‘handmaid’ in Christian group People of Praise.” By the Post’s model of journalistic insinuation, People of Praise is about two removes from the Branch Davidian cult.

It’s an on-the-mark essay if you can get to it beyond the paywall. One more piece of it:

… the Times writers make clear, repeatedly, that Judge Barrett’s religiosity is . . . well, how can one put this? Let us just say that her religiosity is conveyed as not what one would expect to find in polite company today. At least not theirs.

But that same religiosity is found among millions of Americans, who don’t find Barrett’s decision to have a large family and practice a traditional form of faith to be strange at all.

One thing journalists did reflect accurately was how many Republicans kept going on and on and on about her being a married woman with seven kids. And how she played along with it, introducing her sizeable family whenever she could.

Of course the media noticed that. To quote the New York Times:
