Christian web designer at the Supreme Court: How reporters covered 303 Creative case

On the face of it, 303 Creative v. Elenis, a case heard before the U.S. Supreme Court on Monday, sounded unimpressive.

A Christian web designer living near Denver was suing her state civil rights commission for the right to create wedding web sites without having to include creative content about same-sex weddings in the mix. She hadn’t been approached by any gay couples yet — but because she might be, she launched a pre-emptive lawsuit with the aid of the Alliance Defending Freedom, a law firm with an impressive track record of 11 wins at the Supreme Court level.

Yet, the more I read about the case and the issues it was trying to raise, the more intrigued I got. And the hearing on Monday didn’t disappoint. It lasted some two and one-half hours, which is long by Court standards. Covering hour-long hearings at the high court is difficult at best; I can only imagine how tough it was for reporters to sift through 150 minutes of speech — and all the tangents that were involved — to sum up how the hearing went.

Which is why I am merely critiquing the first drafts of what I hope will be more in-depth articles as time goes on. I’ll start with how CBS covered the story:

The Supreme Court's conservative bloc appeared sympathetic Monday to a Colorado graphic designer who argues a state law prohibiting discrimination on the basis of sexual orientation violates her free speech rights by forcing her to express a message that conflicts with her closely held religious beliefs.

During oral arguments in the case known as 303 Creative LLC v. Elenis, the court seemed to move closer to resolving a question it has left unanswered since 2018, when it narrowly ruled in favor of a Colorado baker who refused to make a cake for a same-sex wedding: whether states like Colorado can, in applying their anti-discrimination laws, compel an artist to express a message they disagree with.

An editorial comment: It's a minor annoyance that the plural “they” is used for a singular “artist.” Just write “he or she” for heaven’s sake.

One issue with reporting on this case is that it takes a ton of backstory to explain that this case isn’t just about a web designer, but also a cake designer-baker in a previous Supreme Court case.

Good froth and substance in RNS feature about fading church's jump into coffee shop life

There is a style of news-feature writing that I have heard described, over the years, in words that sound something like this: “Don’t tell me a story about 100,000 people who are wrestling with a big, complex problem. Tell me a story about one person who stands for those 100,000 people.”

For years, this was the style of feature writing that we saw over and over in the “column one” features at the Wall Street Journal and the Los Angeles Times. When used by a skilled reporter, this strategy can help readers understand complex trends and events through the eyes of a well-chosen symbolic person or organization.

One of the biggest religion-news stories out there right now is the slow death of thousands of shrinking churches that face painful questions about what to do with their buildings and the legacies of the believers who once filled the pews. Statistically speaking, most of these churches are old-school mainline Protestant or Catholic congregations in urban or small-town settings. But, truth be told, this is a trend that will torture everybody, sooner or later.

This brings me to a fine Religion News Service story that ran the other day with this double-decker headline:

A once-dying church hopes to reinvent itself with coffee and kindness

Embrace Church had two years left to live. Rather than wait for the end, the church sold its building, reinvented itself and invested in a local coffee house.

Literally, my only question about this story is whether the “summary” paragraph explaining the big picture could have been moved up a bit — somehow. That, gentle readers, is a tiny, tiny nit to pick. Here is the overture:

Community Covenant Church in Kirkwood, Missouri, had a problem common to thousands of churches around the country: an aging congregation, a shrinking budget, a too-big building that spent most of the week empty.

And the clock was ticking.

Gazing into a niche-media future: How politicized might evangelical radio become?

During the heat of the election campaign, the Salem Media Group staged an 11-day “Battleground Talkers” tour that covered politically potent Arizona, Florida, Georgia, Michigan, Ohio and Pennsylvania.

Purpose: To boost conservative voter turnout and nudge undecided voters on what “may be the most important election in the history of our country. … The war for America’s soul is on the line.” The rallies’ Republican and conservative flavor was no surprise, since they featured Salem radio personalities Mike Gallagher, Sebastian Gorka, Hugh Hewitt, Charlie Kirk, Eric Metaxas, Dennis Prager and Brandon Tatum, among others.

Salem Media, a publicly traded firm founded and chaired by Edward G. Atsinger III (469-586-0080), is based in Irving, Texas. It boasts of being “America’s leading Christian media company” — in this context “Christian” means pretty much evangelical Protestant — with radio networks, local stations, syndicated programs, websites, podcasts, marketing services, event planning and Regnery, a major conservative book house.

The “Battleground” personalities appear on the company’s Salem Radio Network, which employs a “conservative news talk” format. Salem says market research indicates such programming “is highly complementary to our core format of Christian Teaching and Talk” heard on other Salem outlets because “both formats express conservative views and family values.”

A thoroughly-reported, 70-inch New York Times examination of the politics of the Salem “juggernaut” October 18 (paywalled here) said, among many other things, that the company consistently promotes “ballot fraud conspiracy theories.”

Such a mix of the sacred and the profane would have astonished the 20th Century founding preachers of conservative Protestant radio such as William Ward Ayer, Donald Grey Barnhouse, Percy Crawford, M.R. DeHaan, Charles Fuller, Aimee Semple MacPherson, Walter Maier or Paul Rader.

Though TV gets the glamour, radio has arguably been more important in building the U.S. evangelical subculture and shaping its substance since World War II.

Is Hollywood afraid to be 'woke'? That's a question with moral and religious implications

It’s one of the most famous quotes ever about the realities of working in Hollywood. That quote: “If you want to send a message, try Western Union.”

Of course, the Tinseltown giant who said that was Frank “It’s a Wonderful Life” Capra, a hero of ordinary people in the heartland. So what would he know about working with the woke powers that be on the left coast, these days?

I bring this up because of a fascinating New York Times lament that ran the other day with this headline: “After #MeToo Reckoning, a Fear Hollywood Is Regressing.” Apparently, progressives in Hollywood are very, very upset with the American people — think heartland folks, again — about some nasty recent returns in ratings and at the box office. Some “message” flicks are bombing.

Here’s the thesis statement: “The takeaway, at least to some agents and studio executives: We tried — these ‘woke’ projects don’t work.”

What does religion have to do with this? Very little, according to the Times (but we will get to that).

It’s clear that, to the team that produced this Times sermon, Middle America simply does not share the concerns of woke artists about systematic racism, sexual abuse and the whole diversity project in general.

Now, you can forget that “Black Panther” juggernaut in multiplexes nationwide, including red zip codes. Stunning, well-crafted Black superhero tales don’t count. Americans just aren’t lining up to watch the morality tales that Hollywood wants them to embrace. But what’s interesting — at least to me — is the degree to which the movies and big-ticket streamed TV series at the heart of this debate often contain content about religious and moral issues that, yes, are LINKED to diversity issues.

In other words, is this a new news story or the latest chapter in an old story about Hollywood’s struggles to understand the more religious and culturally conservative half of the American marketplace?

Let’s start where the Times has chosen to start — with Hollywood’s efforts to clean up its act in the wake of the Harvey Weinstein scandal, etc. Here’s the thesis about the #MeToo aftermath:

The movement led to increased diversity and representation in the entertainment industry, but now there is worry that executives have turned their attention elsewhere.

What happened?

Podcast: Much to learn in ongoing cases with cannabis church and yet another Christian baker

A cannabis church (It’s California) keeps fighting for freedom of worship.

Another Christian baker wins what may be a temporary (It’s California) First Amendment victory in her fight to stay in business, even though she declined to create a one-of-a-kind, artistic wedding cake for a same-sex couple.

What connects these two stories? That was the topic at the heart of this weeks “Crossover” podcast (CLICK HERE to tune that in), which was recorded this week while I was on grandfather duty. This post is a day late because I’ve been driving back to East Tennessee and it’s really hard to write in a car in cross winds on the High Plains.

The connecting link in the podcast is the Religious Freedom Restoration Act of 1993 — or RFRA for short. This was a crucial piece of liberal (in the old sense of the word) church-state law backed by a stunningly broad coalition of religious and legal groups during the Bill Clinton administration. Try to imagine: There were only three “nay” votes in the U.S. Senate. Would that happen now? Clearly, the answer is “nay.’

These days, many reporters act as if “RFRA” was some kind of dirty, four-letter term that cannot be spoken in elite newsrooms. The key is that RFRA doesn’t guarantee a victory for citizens who claim that their First Amendment rights have been violated. RFRA states that people have a right to argue that case and that — following some guidelines that have developed over the years — courts have to take these arguments seriously.

So let’s start with this Religion News Service headline: “Shuttered cannabis church takes fight to reopen to California Supreme Court.” Here’s the overture:

A cannabis church in Southern California — which was shut down by the county of San Bernardino over accusations it was illegally functioning as a dispensary — is taking its fight to reopen to the state Supreme Court, arguing that it uses cannabis for religious healing.

Is celebrity culture eroding American evangelicalism? This publishing insider says 'yes'

Evangelical Protestantism, by most accounts the largest camp in American religion, has run into various troubles lately, as The Guy and many others have chronicled.

Now there’s ample Internet buzz about Katelyn Beaty’s diagnosis of one factor in a new book from a major evangelical publisher that’s well worth coverage: “Celebrities for Jesus: How Personas, Platforms, and Profits are Hurting the Church.”

Make that hurting the “White Evangelical” church.

The type of personality cults she describes are pretty much absent in “mainline” Protestantism, Black Protestantism (there are some glaring exceptions in the health-and-wealth world), Catholicism and other U.S. religious bodies. By coincidence, Rodney Palmer, an American Baptist who teaches preaching at Palmer Theological Seminary, echoed her concerns just last week in an article for the progressive Baptist News Global website.

Inevitably, Beaty has much to say about the media that we practitioners and consumers should ponder.

She’s a well-marinated evangelical as author, former print managing editor of flagship Christianity Today magazine and currently a New York-based acquisitions editor with Baker Publishing Group, one of the majors whose Brazos Press division published “Celebrities.” (Note the company’s other book imprints: Baker Books, Baker Academic, Bethany House, Chosen, Revell.)

For this reason, The Guy finds especially newsworthy — and gutsy — Beaty’s chapter treating the evangelical book industry, which is said to pour “jet fuel” on the type of fandom, branding and marketing she decries.

The bottom line, here: This bite-hand-that-feeds angle alone offers a strong story theme that journalists could draw from this book.

Podcast: So many questions after that symbolic Tampa Bay Rays conflict over 'Pride' logos

Symbolism often plays a major role in tense clashes between people with competing religious beliefs (or secular beliefs, for that matter).

You could see evidence of this fact during and after the recent kerfuffle about a small group of Tampa Bay Rays players who declined to wear special rainbow-logo uniforms during the team’s recent celebration of Pride Month. The media coverage of this clash was the subject of this week’s “Crossroads” podcast (CLICK HERE to tune that in), in part because the stories raised more questions than they answered.

I’ll get to some of those questions, but first let’s look at the Washington Post coverage. Note that this means the Rays conflict was a national story, since the Post doesn’t cover mere regional stories and disputes (see this classic M.Z. Hemingway post about the newspaper’s MIA stance on covering the trial of Philadelphia abortionist Kermit Gosnell).

The headline on this sports-desk story: “Rays players make ‘faith-based decision’ to shun Pride Night logos.” Yes, it’s important to note that there are doubts about the nature of this “faith-based” angle. Let’s look at some important passages in this:

A member of the Tampa Bay Rays said he and several teammates made a “faith-based decision” to not wear rainbow-colored logos on their uniforms during a “Pride Night” home game Saturday that recognized the LGBTQ community.

Most Rays players, per accounts from the game, wore the special uniform designs that had a rainbow pattern over the “TB” on their caps and over a sunburst logo on their right sleeves. The team, which has staged Pride Night for several seasons but had not previously included uniform changes, reportedly gave players the option to display the logos or go with the usual look.

The crucial fact there is that team management decided to allow players some degree of free-will in this case. Hold that thought.

Apparently, team management asked pitcher Jason Adam to make a statement on why he, and four others, elected to wear their usual jerseys for this symbolic event. Thus, he said:

“A lot of it comes down to faith, to like a faith-based decision,” said Adam, a 30-year-old in his fifth major league season.

WICHITA, Kan. — The Hall of Men fits the name, with meetings offering beer, cigars, an open bar, some kind of guy food (think pizza) and lots of chatter around a giant wooden table.

But then there are the evening prayers, icons, Bible readings and lectures about authors whose portraits hang in this “Christian speakeasy.” The names include C.S. Lewis, Flannery O’Connor, W.H. Auden, Dorothy Sayers, Fyodor Dostoevsky, J.R.R. Tolkien and many others. Johnny Cash and Bob Dylan are there, as well.

This group has met twice a month for a dozen years and most of the faithful are Orthodox, Catholic and Lutheran, with plenty of evangelicals at special events. The authors honored are selected after an informal process that usually starts during fellowship before and after lectures, with men talking about books that have touched their lives.”

The whole thing is affected by having that bookstore right next door,” said Pastor Geoff Boyle, a Missouri-Synod Lutheran long active in the project. “The man behind the front counter is used to having these conversations and obviously knows all about the books the guys are talking about. The books are right there and, if they’re not, they will be soon.”

“That bookstore” is Eighth Day Books, which draws customers from across the nation to an old three-story house with 46,000 new and used books — 27,000 titles — shelved and stacked anywhere that will hold them, including the basement “Hobbit Hole” packed with children’s literature. The white-haired man behind the counter is owner Warren Farha, an Orthodox believer with family ties to Lebanon.

This isn’t a “Christian bookstore” complete with knick-knacks, inspirational posters and religious self-help books — but “Eighth Day” is a reference to the Resurrection of Jesus.

Farha created the store in 1988 and selects all the books, with the help of an ecumenical network woven into the Eighth Day Institute and its conferences, newsletters, podcasts and groups such as the Hall of Men and the Sisters of Sophia.

“My goal has always been to be fair to the great traditions,” said Farha, in his office in the bookstore’s attic. “We have classics in history, literature, poetry, church history, theology and philosophy – Christian writings through the ages. … I’m always listening to people who GET the template for what we’re doing here.

“Great books from different traditions are on the shelves right next to each other, even if they clash in ways that we need to discuss.”

In all the stories about Ukraine and the genocide/war happening there, it’s easy to forget the other genocide going on in western China.

A number of weeks ago, Axios.com published a short about China’s “crime’s about humanity” there, particularly against the more than 1 million Muslims who are imprisoned in this 21st century gulag.

Lost in the details of this story is a second angle that would be of great interest to lots of readers in the United States and elsewhere — that Christians too have been caught up in the dragnet.

A Christian Chinese national who spent 10 months in a Xinjiang detention camp has arrived in the United States after months of behind-the-scenes lobbying by U.S. lawmakers, human rights activists and international lawyers.

Why it matters: The man, Ovalbek Turdakun, will provide evidence that international human rights lawyers say is vital to the case they have submitted to the International Criminal Court (ICC) prosecutor arguing that China has committed crimes against humanity in Xinjiang.

Here are several crucial details in this overlooked story:

* Ovalbek and his wife and child were authorized to enter the U.S. on significant public benefit parole, which permits entry for special purposes such as testifying in a proceeding, but does not grant immigration status, because of the value of the testimony they are expected to give. Ovalbek crossed the borders of several Asian countries to get out, finally landing at Dulles Inernational Airport on April 8. Thus:

The big picture: Ovalbek Turdakun is a unique witness to Chinese government repression in Xinjiang, according to international lawyers, U.S. officials and others with knowledge of the case.
